1. Who we are
These Terms of Service (the “Terms”) are between you and Mars B Digital (“Mars B Digital,” “we,” “us,” or “our”). They apply to marsbdigital.com, related customer-facing pages, and Mars B Digital Social Studio (together, the “Services”).
Mars B Digital Social Studio is an independent service. It is not sponsored, endorsed, or operated by TikTok, Postiz, or their affiliates.
2. What Social Studio does
Social Studio supports a user-authorized social-media workflow. When TikTok connectivity is available and approved, an authorized user can connect a TikTok account through TikTok's authorization flow and use Postiz to send user-selected content and posting instructions to TikTok through TikTok's Content Posting API.
Social Studio does not ask for your TikTok password, scrape TikTok, post content without an authorized user's action, or guarantee that TikTok will accept, process, publish, or make content publicly visible. TikTok may limit posting features, permissions, visibility, account eligibility, or API access, including while an API client awaits or undergoes TikTok review or audit.
3. Eligibility and authority
You may use the Services only if you can form a binding agreement and are permitted to do so under applicable law and the rules of each connected platform. If you use the Services for a business or another person, you represent that you have authority to act for them and to connect the relevant accounts.
4. Connected accounts and authorization
- You must connect only accounts you own or are authorized to manage.
- You are responsible for reviewing the selected account, content, caption, disclosures, privacy level, and other available settings before posting.
- You authorize the Services to transmit your selected content and instructions only when you initiate or approve that action.
- You may revoke TikTok access through the applicable TikTok or Postiz account controls. Revocation may stop future TikTok posting functionality.
- You must keep your own account credentials secure and promptly notify us of suspected unauthorized use involving the Services.
5. Your content and responsibilities
You retain your rights in content you submit. You grant us and the service providers involved in the posting workflow a limited license to host, process, transmit, and display that content only as needed to operate, secure, and support the Services and carry out your instructions.
You represent that you have the rights and permissions needed for your content and that your use will comply with applicable law, TikTok's terms and policies, intellectual-property rights, privacy rights, advertising and disclosure rules, and any other connected platform's requirements.
6. Prohibited use
You may not use the Services to:
- access or connect an account without authorization;
- publish unlawful, deceptive, infringing, abusive, harmful, or privacy-invasive content;
- send spam, manipulate engagement, impersonate another person, or misrepresent sponsorship or commercial relationships;
- circumvent platform permissions, posting limits, security controls, review restrictions, or content-moderation decisions;
- copy arbitrary third-party content or remove watermarks or attribution without the required rights and consent;
- probe, disrupt, reverse engineer, or misuse the Services or connected systems except where applicable law expressly permits it.
7. Third-party services
The Services rely on independent third parties, including TikTok, Postiz, hosting providers, and, for purchases made through the website, Stripe. Your use of those services is also governed by their terms and privacy practices. We do not control their availability, policies, review decisions, moderation, account actions, or technical changes.
8. Website products and payments
Any paid digital product displayed on the website is subject to the product description, checkout terms, and any product-specific license supplied with it. Payments are processed by Stripe. Except where required by law or stated otherwise at checkout, access and refund terms are the terms shown for the specific product at the time of purchase.
9. Availability and changes
We may modify, suspend, or discontinue part of the Services when reasonably necessary for security, compliance, maintenance, platform changes, or business reasons. Features dependent on TikTok or Postiz may change or stop working without notice from us. We do not promise uninterrupted service, a particular posting result, audience reach, engagement, revenue, or platform approval.
10. Suspension and termination
You may stop using the Services and disconnect connected accounts at any time. We may restrict or terminate access if we reasonably believe these Terms were violated, the use creates risk or legal exposure, a platform or authority requires it, or continued operation is no longer feasible. Sections that by their nature should survive termination will survive.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, Mars B Digital will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or platform access arising from the Services. Our total liability for a claim will not exceed the greater of the amount you paid us for the affected Service during the six months before the event giving rise to the claim or US $100. These limits do not apply where prohibited by law.
13. Indemnity
To the extent permitted by law, you will defend and indemnify Mars B Digital from third-party claims, damages, and reasonable costs arising from your content, your connected accounts, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.
14. Governing law
These Terms will be governed by the laws of the United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. The courts located in that jurisdiction will have exclusive venue unless applicable law provides another forum.
15. Changes and contact
We may update these Terms as the Services or legal requirements change. The “Last updated” date identifies the current version. If a change is material, we will provide notice where reasonably required.
